Former FBI Director James Comey charged 💥
The Justice Department has charged James Comey
On October 5, 2026, prosecutors filed a sealed two-count criminal information (not a grand-jury indictment) in the U.S. District Court for the District of Columbia (Case 1:26-cr-00229-TNM).
The case was unsealed on October 26.
Exact charges:
Transmission of national defense information — 18 U.S.C. § 793(d)
Conspiracy to transmit national defense information — 18 U.S.C. §§ 793(d) & (g)
Prosecutors allege that on or about October 5, 2016, while serving as FBI Director, Comey knowingly and willfully caused national defense information to be transmitted to a person not entitled to receive it. Specifically, they claim he directed (through one or more co-conspirators) the disclosure of that information to a reporter for a national news outlet.
The filing is tied to events surrounding an October 2016 New York Times article.
DOJ says the information was filed as a “waiverless criminal information” to toll the 10-year statute of limitations while it continues to seek a grand-jury indictment.
This is separate from his still-pending North Carolina case involving the “86 47” social-media post.
